Welcome to Indikin.online ("we," "us," or "our"), a project by Bitjoin Studios. These Terms of Service ("Terms") govern your use of our website (indikin.online), including streaming films, purchasing the Indikin Pass, subscribing to newsletters, joining the whitelist, and applying as a filmmaker. By using our services, you agree to these Terms and our commitment to comply with applicable laws, including the General Data Protection Regulation (GDPR) and the Children’s Online Privacy Protection Act (COPPA). If you do not agree, please do not use our services.

1\. Eligibility

  • You must be at least 13 years old to use our website, as required by COPPA.
  • You must be at least 18 years old to purchase the Indikin Pass or make donations.
  • By using our services, you confirm you meet these age requirements and can legally agree to these Terms.

2\. Account and Sign-In

  • Social Sign-In: You may use Google or Discord to sign up for newsletters or the whitelist. You are responsible for keeping your account details secure.
  • Stored Information: Your email may be saved in your browser to make form-filling easier. You can clear it using your browser settings.
  • Accuracy: Provide accurate information. Using false details may lead to account suspension to ensure compliance with our policies.

3\. Purchases and Payments

  • Indikin Pass: Purchase a one-year Indikin Pass for unlimited streaming. Prices vary (e.g., $49 for Stage 1). Payments are processed through secure platforms like NOWPayments (cryptocurrency) or Stripe in compliance with financial regulations.
  • Support Payments: You can provide voluntary support (i.e., "tips") via Stripe or cryptocurrency (e.g., Ethereum, Bitcoin). These payments are non-refundable, as permitted by law.
  • Payment Terms: Payments are final, except where required by consumer protection laws. Ensure correct cryptocurrency amounts and addresses. We are not responsible for payment errors.
  • Taxes: You are responsible for any applicable taxes in accordance with local tax laws.

4\. Content and Ownership

  • Our Content: Films, text, and images are owned by us or our partners (e.g., filmmakers). You may stream content for personal, non-commercial use only, in compliance with copyright laws.
  • Your Content: By submitting application details (e.g., messages, website links), you allow us to use, store, and display them to process applications and promote our platform.
  • Prohibited Content: Do not submit illegal, harmful, or copyrighted content. We may remove such content and suspend your access to ensure compliance with legal standards.

5\. Revenue Sharing and Tokens

  • Filmmaker Tokens: Some tokens (e.g., $GDAY, $LOLA) may offer revenue-sharing, as decided by filmmakers in compliance with applicable regulations.
  • Indikin Production Fund: Part of streaming revenue supports new film projects.
  • No Guarantee: Revenue sharing and token benefits depend on filmmakers and market conditions. We do not guarantee financial returns.

6\. User Conduct

You agree not to:

  • Use our services illegally or violate laws, including copyright and data protection regulations.
  • Try to hack, tamper with, or disrupt our website or services.
  • Share content without permission.
  • Provide false information.

Violations may lead to suspension or termination of access to maintain compliance with legal and platform standards.

7\. Third-Party Services

We use third-party services like NOWPayments, Stripe, Google, Discord, Google Analytics, Microsoft Clarity, and Cloudflare to operate our platform. You are subject to their terms and privacy policies, which comply with applicable laws. Check Google’s Privacy Policy, Microsoft’s Privacy Statement, Stripe’s Privacy Policy, NOWPayments’ Privacy Policy, Discord’s Privacy Policy, and Cloudflare’s Privacy Policy for compliance details. We are not responsible for their interruptions or data practices.

8\. Limitation of Liability

  • As-Is Service: Our services are provided “as is” without guarantees, as permitted by law.
  • Liability Limit: Our responsibility is limited to the amount you paid for services in the past 12 months, in compliance with consumer protection laws.
  • No Extra Damages: We are not liable for indirect losses (e.g., lost profits), except where required by law.

9\. Termination

  • By You: Stop using our services or request data deletion by emailing [email protected].
  • By Us: We may suspend or terminate access for violations or at our discretion with notice, in compliance with applicable laws.
  • Effect of Termination: Termination may end access to purchased content. Your data will be deleted per our Privacy Policy.

10\. Governing Law and Disputes

  • Governing Law: These Terms are governed by the laws where Bitjoin Studios is based, ensuring compliance with local regulations.
  • Disputes: Disputes will be resolved through arbitration where Bitjoin Studios is based, except for small claims, in accordance with legal standards. You cannot join class action lawsuits.

We may update these Terms to maintain compliance with applicable laws. Changes will be posted on our website with a new “Last Updated” date. Major changes will be shared via email (if provided) or a website notice.
